VEHICLE RENTAL DISTANCE SALES CONTRACT
Pursuant to the 'Regulation on the Implementation Procedures and Principles of Distance Contracts' published in the Official Gazette dated 13.06.2003 and numbered 25137, it is mandatory to conclude a contract for sales conducted over the internet. The contract details are as specified below.
DEFINITIONS
In the implementation and interpretation of this contract, the terms written below shall express the explanations opposite them:
MINISTRY: The Ministry of Customs and Trade,
LAW: Law No. 6502 on the Protection of the Consumer,
REGULATION: The Distance Contracts Regulation (OG: 27.11.2014/29188),
SERVICE: All kinds of consumer transactions and services other than goods provided in return for a fee or benefit,
SELLER (LESSOR): The company that offers goods and services within the scope of its commercial activities,
BUYER (LESSEE): The real or legal person who acquires the good or service for non-commercial purposes,
SITE: The internet site belonging to the SELLER (LESSOR),
ORDERING PARTY: The person who requests via the internet site belonging to the SELLER (LESSOR),
PARTIES: The SELLER (LESSOR) and the BUYER (LESSEE),
PARTIES: This CONTRACT concluded between the SELLER (LESSOR) and the BUYER (LESSEE).

BUYER (LESSEE): The address and contact information used by the customers when requesting service from the www.betacarrental.com site shall be taken as basis.
SUBJECT OF THE CONTRACT
It is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Implementation Procedures and Principles of Distance Contracts, regarding the sale and delivery of the good/service ordered by the Buyer from the Seller's www.betacarrental.com website in the electronic environment, possessing the qualities mentioned in the contract and whose sales price is specified in the contract. The Buyer accepts and declares pursuant to the provisions of this contract that they have been informed about all preliminary information such as the basic qualities of the good/service subject to sale, sales price, payment method, delivery conditions, etc., and about the "right of withdrawal", that they have confirmed this preliminary information in the electronic environment, and subsequently ordered the good/service. The Rental Conditions on the payment page of the www.betacarrental.com site are integral parts of this contract.
CONTRACT DATE
The dates covered by the service requested by the customers from the www.betacarrental.com site are essential.
DELIVERY OF THE GOOD/SERVICE, PLACE OF PERFORMANCE OF THE CONTRACT AND METHOD OF DELIVERY
The service provided by the Seller is provided according to the transfer place determined by the customer and in the manner determined by the customer when requesting the service.
DELIVERY COSTS AND PERFORMANCE
Additional delivery costs belong to the Buyer. If the Seller has declared on its website that the fee of those requesting service above the announced amount will be covered by itself or that it will make free delivery within the scope of a campaign, the delivery cost belongs to the Seller.
BUYER'S DECLARATIONS AND UNDERTAKINGS
If a pre-payment has been made, the refund rules specified in the "Rental Conditions" are valid. If the use of the service has started, the right of withdrawal cannot be exercised. For termination requests before the service usage period expires, the rules specified in the "Rental Conditions" are valid.
CHARACTERISTICS OF THE GOOD/SERVICE SUBJECT TO THE CONTRACT
The type and kind of the good/service, its quantity, brand/model, and the sales price including all taxes are as specified in the information on the good/service introduction page of the website named www.betacarrental.com and in the invoice which is considered an integral part of this contract.
CASH/RENTAL PRICE OF THE GOOD/SERVICE
All prices on the www.betacarrental.com internet site are displayed excluding VAT and all other taxes (subject to changes in the said taxes), unless otherwise stated on our website or in the confirmation e-mail. If the Buyer shops by credit card and in installments, the installment method selected by the Buyer on the site is valid. In installment transactions, the relevant provisions of the contract signed between the Buyer and the cardholder's bank are valid. The credit card payment date is determined by the provisions of the contract between the bank and the Buyer. On our website, for some vehicles, only a pre-payment condition may occur as a payment option. Commission deductions and responsibility arising from the bank to which the money transfer is made belong to the sender.
REQUIREMENTS FOR THE BUYER (LESSEE) WHO WISHES TO ACQUIRE THE GOOD/SERVICE:
1. For economy group vehicles: 23 years of age and at least 2 years of driving license.
2. For mid-group vehicles: 25 years of age and at least 3 years of driving license.
3. For upper group vehicles: 27 years of age and at least 5 years of driving license.
4. Our customers who rent vehicles must have and present their Identity Card and driver's license for citizens of the Republic of Turkey, and their Passport and driver's license for foreign nationals, at the time of vehicle pickup.
DEPOSIT / BLOCK
Beta Car Rental applies a block system according to the vehicles rented by customers. Since these blocks are not a sales transaction, they do not have to be paid to the bank. Our customers who rent must have a digital credit card with Visa and MasterCard emblem issued by their domestic or foreign banks. Individuals who do not have a credit card or whose credit card limit is insufficient cannot perform the block transaction with the direct guarantee of another person who has a credit card. Individuals who have rented before and do not have a credit card may give a <CASH DEPOSIT> with the permission of the operations department authority, and 15 days after the vehicle is delivered, provided that there is no damage, fine, transit fee, etc. debt on the vehicle, the <CASH DEPOSIT> will be refunded to the bank account number specified by the renting individual, deducting the transaction (transfer and EFT process) fee.
RESERVATION
1. Online reservation: You can complete your reservation process in 3 steps by visiting the www.betacarrental.com page.
2. Reservation by Phone: You can make a reservation by phone by calling the Beta Car Rental Call Center at +90 (850) 885 23 82.
Please make your reservation at least three hours in advance so that we can serve you better. Reservations for which the entire rental fee has been paid or the pre-provision fee has been paid are considered definite reservations.
VEHICLE PICKUP AND DELIVERY RULES:
1. If you wish to pick up the vehicle before the reservation date and time, you must inform our Call Center at +90 (850) 885 23 82. The current pickup time will be taken into account as the vehicle pickup time.
2. If you wish to pick up the vehicle after the reservation date and time, the vehicle will be kept waiting for up to 1 hour, and if you pick up the vehicle within this period, the reservation date is taken into account as the current pickup date. Reservations exceeding 1 hour will be automatically canceled by the system and the rental fee will be invoiced to you. (Except for compulsory situations)
3. If the vehicle is returned after the return date and time, no fee will be reflected for delays of up to 2 hours. For delays exceeding 2 hours, a one-day rental fee will be applied.
MILEAGE EXCEEDANCE
The daily rental kilometer in Istanbul is limited to 200 km for economy and mid-class vehicles, and 150 km for upper-class vehicles. For monthly rentals, the kilometer limit for all vehicle groups is 3000 km. A fee of 15 TL will be charged for every exceeding Km.
RENTAL PERIOD EXTENSION REQUEST:
For the extension of the vehicle rental period to be realized, the renting individual must process and inform via the Beta Car Rental website or through the Call Center at least 24 hours in advance. The approved rental period extension request will be calculated over the current daily amount. A service fee of 3 times the rental fee will be requested for the extended rental day without approval or notification.
SITUATIONS WHERE INSURANCE COMPANIES REFUSE PAYMENT:
a. In cases where the LESSEE individual is determined to be under the influence of alcohol and/or drugs at the time of the accident,
b. In cases where a traffic accident report was not prepared, an alcohol report was not obtained,
c. In cases where the traffic accident report, alcohol report, photocopies of the licenses of the vehicles involved in the accident, photocopies of the traffic insurance policies, photocopies of the driver's licenses, the witness determination report, and the declarations and other documents requested by the LESSOR are not submitted to the LESSOR completely and fully within 3 days at the latest from the date of the accident,
d. In case of using the vehicle in violation of traffic laws and/or the matters listed in article 4.4., in intentional accidents,
e. In accidents and/or damages occurring as a result of the vehicle being driven by persons other than the LESSEE and the driver/drivers determined as additional drivers in the rental agreement,
f. In cases where, pursuant to the Compulsory Financial Liability Insurance and/or comprehensive insurance policy general terms of the Turkish Insurance and Reinsurance Companies Association, loss and damage amounts are not paid for any reason whatsoever, and/or in cases where insurance companies do not make payment for any reason. For the LESSEE to benefit from the aforementioned guarantees, they must submit the documents specified in paragraph (c) completely to the LESSOR. Otherwise, these guarantees cannot be benefited from, and the LESSOR is also authorized to separately request and collect the rental fees that will accrue for the period until the date of complete submission of these documents.
FUEL POLICY
Vehicles are delivered with a full tank of fuel and should be received with the same amount of fuel. However, if a fuel deficiency is detected in the vehicle upon pickup, the missing amount will be requested according to the current fuel price and a 500 TL Turkish Lira service fee will be requested. For vehicles not delivered with a full tank, fuel equivalent to the amount of fuel delivered will be requested upon return. In case of fuel less than the delivered fuel amount, the missing part will be taken according to the current fuel price and no service fee will be charged. If the fuel is more, no cash refund is made.
EXTRA CHARGES
Rented vehicles are delivered with a spare tire or tire repair kit, tools, first aid kit, fire extinguisher, and depending on weather conditions, chain equipment. The equipment delivered is specified in the rental agreement. For equipment found missing during return, the invoice amount will be requested from the renting individual. In addition to the equipment, the vehicle ignition key and vehicle registration document are delivered together with the rental agreement. A processing fee will be requested from the renting individual for lost keys and vehicle registration documents.
GENERAL PROVISIONS
The service provider, from the moment it understands that it cannot perform your transfer due to reasons such as mechanical failure in the vehicle, traffic accident, operational disruptions, adverse weather conditions, traffic congestion, terrorist incidents, practices of security forces, etc., which constitute an obstacle to the start or continuation of the service, will try to provide an alternative vehicle as soon as possible and/or will inform otherwise. In the situations we have stated above, the fee for the service whose payment has been received will be refunded to the consumer without deduction by us.
EFFECTIVENESS
This contract is prepared in 1 copy via the www.betacarrental.com website and shall be accepted by the parties, and in disputes arising from the contract, the provisions of the Highway Transportation Law No. 4925 shall be applied. Regarding disputes arising from this contract, Istanbul courts and enforcement offices are authorized. I declare that I have read and accepted this contract on my behalf and/or on behalf of the persons whose names I have written in the reservation form. This declaration of mine is valid even if someone else has carried out and/or signed the reservation process on my behalf. I declare that I have read, understood, and irrevocably accept all the provisions stated on the "Distance Sales Contract" and "Rental Conditions" pages issued in our name as a consumer, the responsibility for the accuracy of the information in the reservation form I have sent, and I pre-accept that this contract has entered into force by my confirmation in the electronic environment.
